02

Settlement can happen at several stages

Disputes may resolve before a lawsuit, during discovery, through mediation, or close to trial. The existence of a lawsuit does not prevent negotiation.

03

Trial is a structured evidence process

At trial, the court applies procedural and evidence rules. Witnesses may testify, lawyers present arguments, and a judge or jury decides the issues assigned to it.

04

Compare the actual terms and risks

A useful comparison considers the written offer, scope of any release, fees and costs, liens or reimbursement obligations, time, evidentiary uncertainty, and the practical demands of continuing. No single factor decides every case.

05

Questions before a decision

Ask what rights the release would end, what amount would remain after deductions, what disputed issues would go to trial, what additional time and costs may arise, and who has authority to accept or reject an offer.
